In Collaborative Divorce, the core elements form your contractual commitments which are to negotiate a mutually acceptable settlement without having the court decide issues, maintain open communication and information sharing, and create shared solutions acknowledging the highest priorities of all of the parties. A Collaborative Divorce can only occur if both parties agree contractually to utilize the Collaborative Practice only. If one party does not wish to participate in the Collaborative Divorce process then the case would become a normal divorce with litigation involving the court system.
